크립토펑크는 홀더에게 IP 라이센스를 제공하는 것이 Punk에게 끝없는 창의성과 가능성의 문을 열어줄 것이라며

홀더는 "크립토펑크 NFT를 보유하는 동안 CryptoPunkNFT와 관련된 CryptoPunk Art를 사용할 수 있는" 라이센스를 부여받게 됩니다.

 

즉, 홀더는 미국 저작권법에 따라 CryptoPunks NFT가 포함된 파생상품에 대한 IP 권리를 소유하게 됩니다.

 

 

한편 유가 랩스(Yuga Labs)는 "모든 저작권, 상표 및 기타 지적재산권을 포함한 CryptoPunk Art에 대한 모든 권리, 소유권 및 이익"을 갖고 있습니다.

 

 

 

Ownership.

(a) You Own Your CryptoPunk NFT.

When you own a digital wallet that holds aCryptoPunk NFT, as recorded by the CryptoPunks Smart Contract, you hold the exclusive right to hold, sell, transfer, and execute blockchain transactions involving that CryptoPunk NFT (“Your CryptoPunk NFT”). Except for the CryptoPunk NFTs we own,Yuga Labs has no right or ability to seize, freeze, or otherwise modify the ownership of any CryptoPunk NFT.

(b) We Own (but License to You) the IP in Your CryptoPunk Art.

Yuga Labs owns all rights, title, and interest in and to the CryptoPunk Art including any and all copyrights,trademarks, and other intellectual property rights therein (“IP”). However, we grant you the License (defined below) to use the CryptoPunk Art associated with Your CryptoPunkNFT (“Your CryptoPunk Art”) for as long as you hold Your CryptoPunk NFT.

(c) You Own the IP in Your Derivative CryptoPunk Works.

As between you and YugaLabs, you own all rights, title and interest in and to any “derivative work,” as defined by the United States Copyright Act, based upon Your CryptoPunk Art created during the License Term (defined below) (“Derivative CryptoPunk Work”); provided, however, that (i) we retain the copyright in the CryptoPunk Art underlying any Derivative CryptoPunk Work; (ii) your use of any Derivative CryptoPunk Work during and after the License Term is subject to these Terms; and (iii) your use of any Derivative CryptoPunk Work after the License Term may require a license from the current owner of the CryptoPunk NFT.

(d) Utility.

Owners may be offered utility, benefits, or entitlements (collectively,“Utlity”) from time to time, but these Terms do not confer any Utility except as granted by the License. Yuga makes no assurances of any Utility. Any Utility may be subject to other terms and conditons. Yuga Labs will not be responsible in any manner for any Utility offered by any third party.

 

 

소유권

(a) 귀하는 귀하의 CryptoPunk NFT를 소유하고 있습니다.
크립토펑크 스마트 계약에 기록된 대로 크립토펑크 NFT를 보유하는 디지털 지갑을 소유하면 해당 크립토펑크 NFT("귀하의 크립토펑크 NFT")와 관련된 블록체인 거래를 보유, 판매, 전송 및 실행할 수 있는 독점적인 권리를 보유하게 됩니다. 당사가 소유한 CryptoPunk NFT를 제외하고 Yuga Labs는 CryptoPunk NFT의 소유권을 압류, 동결 또는 수정할 권리나 능력이 없습니다.

(b) 당사는 귀하의 CryptoPunk 아트에 있는 IP를 소유합니다(그러나 귀하에게 라이선스가 부여됨).
Yuga Labs는 모든 저작권, 상표 및 기타 지적 재산권("IP")을 포함하여 CryptoPunk Art에 대한 모든 권리, 소유권 및 이권을 소유합니다. 그러나 당사는 귀하가 귀하의 CryptoPunk NFT를 보유하는 한 귀하의 CryptoPunkNFT와 관련된 CryptoPunk 아트("귀하의 CryptoPunk 아트")를 사용할 수 있는 라이선스(아래에 정의됨)를 부여합니다.

(c) 귀하는 귀하의 파생 CryptoPunk 작품에서 IP를 소유합니다.
귀하와 YugaLabs 사이에서 귀하는 라이선스 기간(아래에 정의됨) 동안 생성된 귀하의 크립토펑크 아트를 기반으로 미국 저작권법에 의해 정의된 바와 같이 모든 "파생 저작물"에 대한 모든 권리, 소유권 및 이권을 소유합니다("파생 CryptoPunk Work"); 단, (i) 당사는 파생 CryptoPunk 저작물의 기반이 되는 CryptoPunk Art에 대한 저작권을 보유합니다. (ii) 라이선스 기간 동안 및 이후에 파생 크립토펑크 저작물의 사용은 본 약관의 적용을 받습니다. (iii) 라이선스 기간 이후에 파생된 크립토펑크 저작물을 사용하려면 크립토펑크 NFT의 현재 소유자로부터 라이선스가 필요할 수 있습니다.

(d) 유틸리티.
소유자는 때때로 유틸리티, 혜택 또는 권한(총칭하여 "유틸리티")을 제공받을 수 있지만 본 약관은 라이선스에 의해 부여된 경우를 제외하고는 유틸리티를 부여하지 않습니다. Yuga는 유틸리티에 대해 어떠한 보증도 하지 않습니다. 모든 유틸리티에는 다른 조건이 적용될 수 있습니다. Yuga Labs는 제3자가 제공하는 유틸리티에 대해 어떠한 책임도 지지 않습니다.
